Amended land law expected to aid farmland accumulation

Under the draft law being put forth for public comment, the maximum farmland use term will be extended to 50 years from the current 20 years.
The farmland quota is kept unchanged compared to the 2003 Land Law. Each household and individual will be allocated at most three hectares of farmland for growing annual plants, making salt and farming aquatic products, while the quota for perennial crops is ten hectares in deltas and 30 hectares in mountainous areas.
However, a new point in the draft is that each farming household and individual can take transfers of land rights over a total area of farmland that is ten times larger than their quota. The current level of farmland use right transfer is two times.
The new provision will facilitate farmland accumulation, which is deemed as consistent with the country’s economic transformation and labor structure.
Despite the more liberal provisions, experts said the amended law should remove farmland quota and land-use term, and instead establish a mechanism for supervision over the decisions on farmland allocation of the localities.
Moreover, in order to form large-scale production zones, farmers need to have sufficient land for cultivation. If farmland use restrictions were removed, farmers could accumulate land to develop large-scale specialized farms, and thus the Government would soon accomplish the goal of agriculture, rural and farmer development.
Therefore, farmers expected the amended Land Law would eliminate farmland use limits and let farmland use right transfers be driven by market forces, said experts.
